Judgement for the case Beloff v Pressdram Ltd

Journalist for Observer produced an article, extracts of which were reproduced by Private Eye. Journalist, as well as her work for Observer, also wrote books and gave broadcasts which were not part of her employment with Observer. Issue was whether she was ‘employee’ of paper. Held:
·        Journalist was under contract of service.
Ø  This despite work done elsewhere.
·        Relevant factors in this are:
Ø  She has a regular salary, which is not affected by financial success of Observer
Ø  She uses Observer’s equipment and staff
Ø  She has office at Observer
Ø  Observer contributes towards her salary
