Judgement for the case Metrobus Ltd v Unite the Union

Table Of Contents

  • A union had balloted those it intended to call upon to strike successfully.

  • However CA awarded an injunction against the strike because of defects in the notice given to the employer:

    • There was unreasonable delay in notification (2 days) and

    • Had failed to include in the ballot an explanation as to how the total of the various categories of employees had been reached.

  • However the fact that it overstated the number of eligible employees to take part in the ballot by 12 (out of workforce of 850) was insignificant.
