A union had balloted those it intended to call upon to strike successfully. However CA awarded an injunction against the strike because of defects in the notice given to the employer: There was unreasonable delay in notification (2 days) and had failed to include in the ballot an explanation as to how the total of the various categories of employees had been reached. However the fact that it overstated the number of eligible employees to take part in the ballot by 12 (out of workforce of 850) was insignificant.
