Judgement for the case Pitts v Hunt

  • Plaintiff and Defendant were drunk and drove home on Plaintiff’s motor bike. Pitts, encouraged by Hunt, drove dangerously, causing an accident in which Defendant died and Plaintiff was injured.

  • Plaintiff sued Defendant’s estate for damages.

  • CA held that due to the 1988 Act, s.149 (3) (see above) the defence of violenti non fit iniuria couldn’t apply.
