Judgement for the case Pitts v Hunt

P and D were drunk and drove home on P’s motor bike. P, encouraged by H, drove dangerously, causing an accident in which D died and P was injured. P sued D’s estate for damages. CA held that due to the 1988 Act, s.149 (3) (see above) the defence of violenti non fit iniuria couldn’t apply.
