R v Jones

[2004] EWCA Crim 1981

Case summary last updated at 13/01/2020 14:50 by the Oxbridge Notes in-house law team.

Judgement for the case R v Jones

D damaged RAF property to try and prevent the damage to others’ property in the Iraq war which D believed to be illegal. D relied on defence of private defence AND necessity but was convicted. CA said that s.3 Criminal Law Act 1967 (private defence) AND necessity only related to the prevention of a domestic “crime”, and “international aggression” was not justiciable in national courts. Thus appeal dismissed.
