VISITORS

No entry clearance needed for non-visa nationals if stay is up to 6 months. ENTRY CLEARANCE MANDATORY FOR ALL CATEGORIES.

Leave to enter conditions:

  • Stay should not exceed period of 6 months

  • Prohibition on employment

  • No recourse to public funds

No restriction on frequency of visits but there should be intervals between them – should not spend more than 6 out of 12 months in the UK.

TYPE OF VISITOR PARAGRAPH (IMMI. RULES) REQUIREMENTS

GENERAL VISITOR: person living or working outside UK entering for tourism

Multi entry visas – 6 months, 12 months, 2 years, 5 years and 10 years. Still can only stay in UK for 6months

If family/friends sponsor G.V – may be asked to give a written undertaking for maintenance and accommodation.

Where application would normally be refused, G.V given benefit of doubt and asked to provide written statement declaring intentions.

*Permitted study* = up to 30 days recreational activity, English Language or academic study provided it is not the main purpose of visit.

42 - not exceeding 6months, prohibition on employment and no recourse to public funds.

  1. Genuinely seeking entry for limited period not exceeding 6months and not exceeding 12 months for academic visitor (41(i))

  2. Intends to leave the UK at the end of stay (41(ii))

  3. Does not intend to take up employment (41(iii))

  4. Does not intend to produce, sell goods or provide services directly to public (41(iv))

  5. Does not intend to undertake course of study unless ‘permitted study’ (41(v))

  6. Will maintain and accommodate himself and any dependants without recourse of public funds or taking up employment, can be maintained by friends and family (41(vi))

  7. Can meet cost of return journey (41(vii))

  8. Is not a child under 18 (41(viii))

  9. Does not intend to do any of the activities listed in 46G(iii), 46M(iii) or 46S(iii) (41(ix))

  10. Does not intend to marry or form C.P during visit or give notice of marriage or C.P during stay (41(x))

  11. Does not intend to receive private medical treatment during visit (41(xi))

  12. Is not in transit to a country outside the Common Travel Area (41(xii))

  13. Where seeking leave to enter as general visitor to take part in archaeological excavations, provides a letter from director or organiser of the excavation stating length of visit and accommodation/maintenance arrangements.

STUDENT VISITOR

  • Undertake short period of study as a visitor which should be completed within 6 months limited leave; or

  • As a student, to study for 6 months or less, provided he does not take up part time employment, or undertake paid or unpaid work placement as part of court.

English language concession:- student wishing to learn English as foreign language – 6months can be exceeded but not more than 11 months.

56K

56L – leave cannot exceed 6 months, prohibition on employment and no recourse to public funds

  1. Genuinely seeking entry as student visitor for limited period, not exceeding 6 months (56K(i)) and;

  2. Has accepted court of study which is to be provided by an institution which is:

  1. Hold of a sponsor licence for Tier 4 of the points based system, or

  2. Accreditation UK, the Accreditation body for language and services (ABLS); the British Accreditation Council (BAC) or the Accreditation Service for International Colleges (ASIC), or

  3. The holder of a valid and satisfactory full institutional inspection, review or audit by one of the following bodies: Bridge Schools Inspectorate; the Education and Training Inspectorate; Estyn; Education Scotland; the Independent Schools Inspectorate; Office for Standard in Education; the Schools Inspection Service or the Education and Training Inspectorate Northern Ireland, or

  4. An overseas Higher Education Institution offering only part of its programmes in the UK, holding its own national accreditation and offering programmes that are of a level equivalent to a UK degree (56K(ii)); and

  1. Intends to leave the UK at the end of his visit (56K(iii)); and

  2. Does not intend to take up employment in the UK 56K(iv)); and

  3. Does not intend to engage in business, to produce/sell goods or provide services direct to public (56K(v))

  4. Does not intend to study at a maintained school (56K(vi))

  5. Will maintain and accommodate himself and dependants without recourse to public funds or taking employment (can be maintained by family/friends) (56K(vii))

  6. Can meet costs for return journey (56K(viii))

  7. Is not a child under 18 (56K(ix))

  8. Meets the requirements set out in 41(ix)-(xii) (from above)

BUSINESS VISITOR

  • Based abroad and has no intention of transferring his base to UK, even temporarily;

  • Will not receive his salary from UK source; and

  • He will not be involved in selling goods or service to public directly
