Judgement for the case Tetra Pak v Commission

Had company that had large Market share but also acquired exclusive patent and know-how license to operate in the market of cartons for milk. Court took view that fact that they had those intellectual property rights strengthened there position of dominance. So court looked not only at market share, but also at the barriers. Comment: Are we punishing for just being better?
